To Whom It May Concern:
I contracted with a Marble company in Newark, Ca to do a bathroom remodel where they were to install new jacuzzi tub, and 3 marble walls. What was supposed to be a 2 week job, it turned out to be 3 months of hell. They didn’t have a permit before they started the work, and they tracked their dirt in on my new carpets; and left a hot glue gun dripping on my new marble sink; tore my towel bar down,and were very un-professional. I wouldn’t recommend them to satan himself. I went through so much with this company
To be brief, I contacted BBB and filed a complaint, then contacted Atty. General’s Office, also State contractor’s Board and filed a complaint which got them 9 serious violations. After numerous complaints, I was taken to court by this company because they did not install anti-scald guard on tub, and they wanted me to pay for the permit.(The nerve of those people). Very shoddy work. I lost case in court and was to pay the company $350 which I was told I could pay in installments. Then she reneged on agreement and told me to pay in full or she would put a lien on my house (which she did). I took them to court and sued for permit (which I won). To make a long story shorter; I paid the amount I lost in court, for the anti-scald quard not getting installed (but I had to pay for), and I couldn’t sell my house until lien got paid, then to top it off, the paid judgment remains on my credit files for 7 years.
Please warn every consumer about this company and their rude,un-professional mannerisms.
I got taken good for over $6000 for a simple remodel of a new tub and 3 marble walls.

Our story is very similar to everyone else’s so not sure it is important to repeat. We have a great architect, structural engineer and a strong line item contract with a stated contractual due date .., and still here we are. Our Contractor is blantantly violating the terms of his contract and statutory laws. He arrogantly admits such in writing without the fear of regulatory or legal repercussions They know they are beyond reproach if Homeowners used traditional methods to hold them accountable, especially in California where courts are backlogged for years, if you receive a judgment it is difficult to collect, and regulatory agencies are all short staffed due to California’s current budget constraints.
We have come to the conclusion that if we dismiss our contractor and then pursue legal or regulatory remedies we are playing into his hands; that is exactly what our contractor wants us to do so he can go on with the next remodel without having us in his hair.
Instead, we holding our Contractor to his contract, sending multiple daily emails advising him of his violations under the terms of his contract and statutory laws, sending his copies of case law which gives him example of similar situations in which Contractors have lost their Contractors license, news of the Attorney generals action against Contractors, telling him every step we are taking towards pursuing complaints with regulatory boards, summaries of every conversation we have with regulatory employees, of steps we are taking to collect information towards filing the complaints, conversations we have with Contractors employees or subs, ,are taking whatever avenues are available to us, without crossing a legal line. Our hope is that we will interfere to such a degree in the Contractors day to day operations and ability to generate income he will agree to complete our remodel (under the supervision of a 3rd party) without delay so we can both part ways. That is the only incentive a homeowner can generate to get a Contractor to perform his contractual and legal duties.
We have proof of fraud on every level….we believe we have the ability to pierce the corporate umbrella, our contractor’s board says that if we file a complaint against his license it will be revoked, we can sue but for what purpose — it will take five years, lots of $$ and judgments are difficult to collect.
We are professionals in the accounting and business field so we are proficient in W.C., Payroll, and business law. We can easily access relative state statutes and relevant case law. We are tenuous, intelligent and avid researchers. We want to collaborate on specific solution paths for consumers forcing contractors to comply with the terms of their contracts and regulatory statutes before legal solutions have to be considered and provide specific information for homeowners so they are better equipped to understand the environment they are in such as:
• How to find State Regulatory Boards
• How to file a Regulatory Complaint
• How to find State Statutes
• Reliable case law from govt and legal sites without cost
• Identification of certified copies of licenses homeowners can request from Contractors which will enhance your legal position if your contractor refuses to provide
• How to set up a written communication trail between yourself and Contractor to support a contractors complaint which will support a surety bond claim WHICH WILL ACTUALLY PAY OUT
• How do you prove W.C. fraud
• How to understand contractors talk which sounds great but covers up the use of unlicensed subs and employees not reported to regulatory agencies
• Discussion of Line Item Contracts
We would like a greater understanding on
• Discussion of legal ramifications & how to avoid them if you wish to name Contractor on consumer web-site
• Most Reliable and Comprehensive web site to pay for investigative info,
• To what extent can you legally contact Contractors prior and current customers, subs and employees to gather information
We are very capable of continuing our plight alone but we would rather join forces to reduce the time it takes for us to move forward while assisting others in our area of expertise.

Looking for homeowners that have been taken advantage of by contractors. There is now another way we can fight back. Preventive measures.
